While most states allow the use of stun guns for a person’s safety there are a handful of states that do not permit them.

The short answer to finding out whether or not stun guns are legal in New Jersey is that they are not. New Jersey is one of the states that has restricted the use of this self defense device for public use.

Under the New Jersey Statutes – Title 2C of the New Jersey Code of Criminal Justice – Chapter 39-1, it states that “Weapon” means anything readily capable of lethal use or of inflicting serious bodily injury. The term includes, but is not limited to…and (4) stun guns; and any weapon or other device which projects, releases, or emits tear gas or any other substance intended to produce temporary physical discomfort or permanent injury through being vaporized or otherwise dispensed in the air.”

And

“Stun gun” means any weapon or other device which emits an electrical charge or current intended to temporarily or permanently disable a person.”

As possession of a stun gun is prohibited in New Jersey anyone who knowingly has one of these in the possession is guilty of a crime in the fourth degree.
